These Terms of Service create a binding legal agreement between you and Contesmo Media which owns and operates Contesmo site and services (collectively “we”, “our” or “us”).

By using the Contesmo site, you are agreeing to the following terms:

As a user (“You,” “Your”) of the Contesmo site (“Site”), services (“Services”), and visual or verbal information (“Content”) provided by Contesmo (“Us,” “Our,” “We”), its users (“User Content” or “User Generated Content”), or partners from whom we may license data or content (“Partner Content” or “Third Party Content”), including, but not limited to, the Contesmo website at http://contesmo.com, the Contesmo application programming interfaces (“Contesmo APIs”), and the mobile applications created by Contesmo, you are agreeing to be bound by the following Terms and Conditions (“Terms of Service” or “Terms”). You acknowledge that these Terms are part of our Site Privacy Policy (“Privacy Policy”), which is incorporated by reference, and by accessing or using our Site, you agree to be bound by all of its terms and conditions. Contesmo is not responsible for any conflicts between You and our clients, third party affiliates or partners outside of the Contesmo Service.

The failure of Contesmo to exercise or enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

We may modify these terms without explicit notice

These Terms of Service apply to all current features and to new features that are added to the existing Service.

Contesmo reserves the right to modify these Terms of Service without explicit notice. We will notify members with active accounts of material changes to these Terms of Service by email or by posting a notice on our Site. These Terms of Service and the Privacy Policy, which can be found at http://contesmo.com/privacy and the Refund Policy, which can be found at http://contesmo.com/refunds, constitutes the entire agreement between you and Contesmo and govern your use of the Service, superseding any prior agreements between you and Contesmo (including, but not limited to, any prior versions of the Terms of Service).

We collect the following types of information from our users:

Personal Information. If you create an account to take advantage of the full range of services offered on the Contesmo Service, we ask for and record Personal Information such as your email address. Your Personal Information will not be visible to other users. Contesmo may contact you using the Personal Information you provided to communicate with you and to send you information about our services and / or the services of our third party affiliates and promotional partners that we feel may be of interest to you.

Your Public Content. By submitting Your Public Content to Contesmo, including your public profile information such as your Display Name, you recognize that we store and may publicly display Your Public Content, along with your Display Name, in order to provide the services that we offer.

Feedback. If you contact us to provide feedback, register a complaint, or ask a question, we will record any Personal Information and other content that you provide in your communication so that we can effectively respond to your communication.

Activity. We record information relating to your use of the Contesmo Service, such as the searches you undertake, the pages you view, your browser type, IP address, requested URL, referring URL, and timestamp information. We use this type of information to administer the Contesmo Service and provide the highest possible level of service to you. We also use this information in the aggregate to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Contesmo Service. You cannot be identified from this aggregate information.

Login location. When you sign into Contesmo, we use your approximate physical location (based on the Internet Protocol address of your computer or your Current Location, should you choose to provide it, via your mobile device) as a verification method for physical locations to ensure the scan originated at the location is should have.

Cookies. We send cookies to your computer in order to uniquely identify your browser and improve the quality of our service. The term “cookies” refers to small pieces of information that a website sends to your computer’s hard drive while you are viewing the Service. We may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your computer until you delete them). Persistent cookies can be removed by following your browser help file directions. If you choose to disable cookies, some areas of the Contesmo Service may not work properly or at all.

Enforcement. We may use the information we collect in connection with your use of the Service (including your Personal Information) in order to investigate, enforce, and apply our TOS and Privacy Policy.
